ORDINANCE NO. 12-2020

AN ORDINANCE AMENDING CHAPTER 12, ARTICLE 2 [ZONING REGULATIONS] TO AMEND
THE CALCULATION OF GROSS LAND AREA PERMITTED TO BE UTILIZED AS AN
ACCESSORY USE OR ACCESSORY STRUCTURE

WHEREAS, the Board of Trustees the "Board") of the Town of Grand Lake, Colorado, pursuant to
Colorado Statute is vested with the authority of administering the affairs of the Town of Grand Lake, Colorado; and

WHEREAS, the Planning Commission of the Town of Grand Lake (the "Commission"), pursuant to Colorado Revised Statutes and the Town of Grand Lake Municipal Code ("The Code"), is vested with
the authority to perform such duties as are conferred upon them; and,

WHEREAS, the authority of the Commission includes, but is not limited to, adopting resolutions which
recommend amendments, repeals, or changes to Code related to land use matters, and;

WHEREAS, the Town of Grand Lake has previously adopted land use and zoning regulations under
Chapter 12, Article 2 of the Code; and

WHEREAS, the Planning Commission met on July 15, 2020 and passed Resolution 05-2020 recommending the Board amend the definition in Chapter 12 Article 2 for "Accessory Uses and Structures" to modify the maximum percentage of the gross land area permitted to be utilized for an accessory use or structure on a given lot; and

WHEREAS, the Code currently limits the gross land area used for accessory uses and structures to 10 percent of the building footprint of the main structure; and

WHEREAS, many of the homes in Grand Lake are constructed in multiple levels and therefore have
relatively small land area utilized compared to the total size of a home; and

WHEREAS, due to the nature of construction of many Grand Lake homes, the current percentage
limitation calculation results in unnecessarily undersized accessory structures such as garages, and
consequently often common sized yet non-conforming accessory structures; and

WHEREAS, Section 12-2-6 of the Code defines "Building Areas" as the portion of the lot that can be
occupied by the principal use, excluding the front, rear and side yards; and

WHEREAS, the Planning Commission and Town staff has recommended permitting a property owner to utilize 10 per cent of the Building Area as the maximum gross land area for all accessory uses by right rather than the current 10 per cent of the gross land area utilized by all uses by right (emphasis added); and

WHEREAS, the Board has determined that it is in the interest of the Town to amend the definition of
Accessory Uses and Structures located in Chapter 12, Article 2 of the Code to reflect its recommendation.

NOW THEREFORE BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF GRAND LAKE, COLORADO AS FOLLOWS:

1. The definition of "Accessory Uses and Structures" located in Chapter 12, Article 2 of the Town of Grand Lake Municipal Code is hereby amended, by adding the bold underlined language and removing the strikethrough language, to read as follows:
12-2-6 Definitions
Accessory Uses and Structures - A use naturally and normally incidental to a use by a right, and complying with all of the following conditions:
(a) Clearly incidental and customary to and commonly associated with the operation on the use by right;
(b) Is operated and maintained under the same ownership as the use by right;
(c) Includes only those structures or structural features consistent with the use by right;
(d) The gross land area utilized by all accessory uses of all uses by right on the same property shall not
exceed ten percent (10%) of the gross land area utilized by all the uses by right (see Building Area of the property) and the gross land area utilized by all accessory uses of all uses by right shall not exceed the gross land area utilized by all uses by right;
(e) May include home occupations, as defined by this Article or;
(f) Overnight camping on private residential property, by the owner or guest, for a period not exceeding seven (7) consecutive days.
2. Severability: If any Article, Section, paragraph, sentence, clause, or phrase of this Ordinance is held to be unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions of this Ordinance. The Board of Trustees declares that it would have passed this Ordinance and each part or parts thereof irrespective of the fact that any one part or parts be declared unconstitutional or invalid.
3. Repeal: Existing Ordinances or parts of Ordinances covering the same matters as embraced in this
Ordinance are hereby repealed and all Ordinances or parts of Ordinances inconsistent with the provisions of this Ordinance are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any Ordinance hereby repealed prior to the taking effect of this Ordinance.
