PUBLIC NOTICE TOWN OF WINTER PARK BOARD OF ADJUSTMENT ZONING VARIANCE REQUEST Applicant / Owner: William MacDonald and Brittany Nudge Mailing Address: PO Box 216 Fraser, CO 80422 Street Address of Properties for Which the Variance Is Requested: 365 Lionsgate Drive, Winter Park Legal Description of Properties for Which the Variance Is Requested: Miller Subdivision Tract: 3 Owner's Detailed Description of Request: "Alter the crawl space of an existing single family home into a finished basement (800 square feet)" Applicable Provisions of the Town Code: Section 7-5B-1 of the Town Code states - "The objective of the D-C zone is to encourage intensive mixed residential and commercial uses on parcels of land in those areas designated as centers of visitor oriented activity in the master plan for the town. (Ord. 317, Series of 2002)." Due to this stated purpose, single family residential dwellings are not a permitted use in the D-C district as seen in Section 7-5B-2 of the Town Code. This request would therefore result in the expansion of a non-conforming use within the D-C District and consequently requires a zoning variance. The Board of Adjustment will review this case and render a decision under Section 7-8-1 of the Town Code.
